When two people are under the influence of the most violent, most insane, most delusive and most transient of passions, they are required to swear that they will remain in that excited, abnormal and exhausting condition continuously until death do them part.
~ George Bernard Shaw, 1963
Contested vs. Uncontested Divorce
A contested divorce occurs when spouses do not agree on one or more divorce related issues. In these cases, a judge typically choose a resolution for each issue in a trial or court hearing, resulting in each party hiring an attorney. Typical areas of disagreement are alimony payments, debt assignment, property division, and child custody.
An uncontested divorce takes place when the spouses can agree on every issue of the divorce. Even when amicable, spouses should each retain an attorney to be their consultant for answering legal questions and drafting agreements involved in the divorce proceedings.
Military Divorce
Military divorce proceedings present a different, and sometimes more difficult, set of circumstances because special laws apply for certain aspects of military divorce and separation procedures.
The attorneys with Thomas & Thomas Law, PLLC have the experience and knowledge to guide you through each aspect of a military divorce including the residency requirements for filing, division of pensions, legal protections for the military member and court orders affecting child support. The firm follows current rules and federal laws regarding the Service Members Civil Relief Act, court jurisdictions, and filing requirements to ensure you and your rights are protected.
