Contested vs. Uncontested Divorce

A contested divorce occurs when spouses do not agree on one or more divorce related issues. In these cases, a judge typically choose a resolution for each issue in a trial or court hearing, resulting in each party hiring an attorney. Typical areas of disagreement are alimony payments, debt assignment, property division, and child custody. 

An uncontested divorce takes place when the spouses can agree on every issue of the divorce. Even when amicable, spouses should each retain an attorney to be their consultant for answering legal questions and drafting agreements involved in the divorce proceedings.
