Family law encompasses all legal matters pertaining to family and/or domestic issues. These issues include legal help for adoptions, appeals, arbitration, child custody, estate planning, non-traditional family, paternity, child visitation, guardianship and child support. Child custody, visitation and support are perhaps the most difficult matters to settle.
Child Custody
Virginia courts, as well as all courts, place priority on what is best for a child involved with divorcing parents. Emotional and material issues very often muddle sound judgment in resolving this complex issue. In some cases, the court is forced to decide which of the parents is better suited to receive custody in the best interest of the children. If you do not have an attorney, your chances of pleading your case effectively are seriously diminished.
It is extremely important to understand the various types of custody:
- Legal Custody
- Sole Legal Custody
- Joint Legal Custody
- Physical Custody
- Sole Physical Custody
- Joint Physical Custody
- Bird's Nest Custody
Child Support
Both parties in a divorce stand to lose more than what is fairly decreed in child support and alimony cases. Effects of these rulings can project undue long-term hardships on each party's quality of life. Your attorney will place you in a position to better present what is fair depending on the unique circumstances of your case. Our office has extensive experience in all areas of family law.
Child Visitation
Visitation agreements must be submitted to the court for approval, to ensure the best interests of the child. The court is required to protect the child; visitation that creates a risk will not be approved. When parents do not agree arrangements, the courts may recommend mediation. Once visitation is settled, the court includes the agreement in the final divorce and custody order.
Types of visitation include:
- Unsupervised Visitation
- Supervised visitation
- Limited Visitation
- Virtual visitation

-
Adoptions Child adoption can be a source of great joy to couples wanting to have children. However, some issues of adoption can cause emotional drawbacks if the procedure is not handled properly. Your attorney will be an asset in constructing a legal contract concerning your planned child adoption. These contracts can, for instance, deter future legal issues should the natural mother change her mind after the adoption.
-
Guardianship Guardians and conservators are appointed to protect an incapacitated person.
-
Estate Planning Most people do not like to think of estate planning because it conveys a "morbid" stigma. However, estate planning is very important: if something should happen to you and there is no documentation expressing how you want your assets distributed or disposed of, the courts can take control and disperse your assets as it sees fit. Examples of planning documents: wills, living wills, trusts and durable power of attorney.
