Legal Help Obtaining Your Social Security Disability Claim

These days, submitting for a rightful Social Security Disability claim becomes a long drawn-out ordeal with the majority of claims being denied for the first and second attempts. The Federal Government has put laws in place that are designed to prevent Social Security Disability (SSD) and/or Supplement Security Income (SSI) fraud. Unfortunately, these laws can seriously delay the claimant from ever getting an approval in a reasonable timeframe without the help of an attorney that specializes in these types of cases.

Requiring the assistance of an attorney becomes critical as, in many cases, the claimant is unable to work or generate income. Receiving a timely approval of these benefits can mean the difference in keeping a roof over their head or putting food on the table.

What Is Social Security Disability (SSD)?

The Federal Social Security Disability Act defines “disability” as the “inability to engage in any substantial gainful activity by reason of any medically determinable physician or mental impairment which can be expected to last for a continuous period of not less than 12 months or result in death.” In this case, Social Security Disability Benefits are paid to those that have been gainfully employed over the previous 5 to 10 years but can no longer work due to a debilitating physical or mental condition that prevents someone from continuing their employment effectively.

Filing for SSD should be performed immediately upon being determined by a medical professional that you will not be able to work over the coming 12 months or the condition is expected to lead to death. Compensation is determined on how much you have earned in the past. Typically, claimants receive the same compensation they would have received if they had worked through to retirement (age 65+). Benefits for widows are also determined by how much the deceased spouse had earned. Short-term disability under 12 months does not qualify for SSD benefits.

What is Supplemental Security Income (SSI)?

SSI benefits are paid to the poor and disabled regardless of whether they have ever been employed in the past.
